A man who drunkenly told his partner “I’m going to murder you” has been fined.

Thomas Smith (61) pleaded guilty to uttering a threat of violence at an address in Falkirk on March 9.

Smith, 150 Moss Avenue, Caldercruix, appeared at Falkirk Sheriff Court last Thursday.

Discussing a report, Sheriff Derek Livingston addressed Smith’s defence solicitor, William McIntyre, and said: “He’s got a lack of insight into what constitutes a threat but said, ‘I’m going to murder you’.”

The solicitor suggested it was a phrase “said in different ways by different people”.

The Sheriff replied: “He might not have intended it but it’s still a threat.”

The court heard Smith had been drunk at the time of the offence and the woman had called police to the property.

Mr McIntyre added: “They want to reconcile. She just wanted him to be taken away from the door.”

Smith was fined £225 and ordered to pay a £10 victim surcharge.
